1.     This website, www.tcotef.com (the website), is operated and owned by the entity trading as The Church of the Eternally Forgiven ABN 86 121 691 452 (referred to herein as TCEF) located in Australia.  

 

2.     All references to currency on this website are in Australian Dollars unless otherwise expressly specified.

 

Acknowledgment and Acceptance

 

3.     Access to and use of the website, and the products and services available through the website, are subject to these Terms and Conditions (the Terms). By accessing and/or using the website, you agree to the Terms which may be updated from time to time without notice.

 

4.     You acknowledge and agree that you shall be liable for any breach of the Terms and that you are responsible for your activity in connection with the website including, but not limited to, any fraudulent, malicious, harmful, abusive or otherwise illegal purpose or activity.

 

5.     TCEF reserves its right to refuse, withdraw or restrict access to the website, or to remove the website, at any time and for any reason without notice and shall not be liable if the website is unavailable for any period.

 

6.     You agree that purchases made through the website must be for personal use only and not for resale or business use.

 

7.     If you breach any of the Terms, TCEF may take any action it deems appropriate including, but not limited to, prohibiting you from accessing the website and bringing court proceedings against you.

 

8.     You acknowledge that the website is not intended for use by minor children and that, if a child accesses and uses the website, the legal guardian of the child will be solely responsible for the online conduct of the child, monitoring the child’s access to the website and any consequences of use of the website by the child.

 

Orders, refunds and exchanges

 

9.     By placing an order for any products and services through the website, you make an offer to purchase the products and services at the price specified on the website at the time that the order is placed (the Offer) and payment is taken upon placement of the order. TCEF may accept or reject the Offer for any reason including, without limitation, the unavailability of the products or an error posted on the website in which case the amount paid by you will be refunded.

 

10.  Upon acceptance of the Offer, TCEF shall process the order within a reasonable period of time and shall then post the product(s) ordered through Australia Post to the address that you nominate when placing your order. TCEF shall not be responsible for any delays in delivery or missing items after posting the product(s).

 

11.  When placing an order, you must ensure that all information and instructions supplied to TCEF are correct and complete and that you are authorised to place the order and to supply the information. Further, when placing orders addressed to recipients other than those specified in the billing address, you warrant that you have obtained permission for the disclosure of personal information under the Privacy Act 1988 (Cth) for third party recipients.

 

12.  T-shirts ordered through the website may be returned and exchanged if an incorrect size or colour is ordered in error provided that:

 

(a)   you pay for the postage required for the return and the exchange; and

 

(b)  the item is unworn, unwashed and has the original tags attached; and

 

(c)  your request for a return and exchange is made within 21 days of the order date.

 

13.  Products shall not be exchanged or refunded if you make a spelling error when placing an order through the website. In the event TCEF has made a spelling error and you provided the correct spelling details, you may return the product for an exchange or a refund.

 

14.  Products ordered through the website may not be exchanged or refunded other than as expressly specified in the Terms except in accordance with applicable consumer protection legislative provisions.

 

15.  While Australian tax (GST) is removed from international orders, your order to countries other than Australia may be subject to local custom duties and local taxes in the country of destination and such charges shall be borne by the recipient.

 

16.  Title and risk in a product purchased through the website passes to you upon confirmation from TCEF that your order has been accepted.

Privacy

 

17.  Our Privacy Policy published on the website forms part of the Terms and, by using the website, you consent to our collection of your personal information in accordance with our Privacy Policy.

 

Security

 

18.  While TCEF use all reasonable care and skill to ensure that the website is secure and free from harmful defects or viruses, it does not guarantee internet services will not be subject to interference, breakdown, delays or computer errors. To the extent permitted by applicable law, TCEF shall not be liable for any security issues which are associated with the website.
